YOO & TOO Capital Ltd website and application terms.

These terms govern the use of the YOO & TOO Capital Ltd website and mobile application. By accessing our services, you agree to be bound by these terms.

1. Introduction

Accessing the service means accepting the governing terms.

These Terms and Conditions govern the use of the YOO & TOO Capital Ltd website and mobile application. If you do not agree to these terms, please do not use our services.

2. Eligibility

Borrowers must meet the minimum access requirements.

  • You must be at least 18 years of age.
  • You must be a resident of Uganda with a valid National ID (NIN).
  • You must have a registered Mobile Money account (MTN or Airtel) in your legal name.
3. Loan Applications & Disbursement

Applications remain subject to approval and lending review.

  • All loan applications are subject to credit approval.
  • By applying, you authorize YOO & TOO Capital Ltd to pull your credit report from any licensed Credit Reference Bureau (CRB).
  • Approved loans will be disbursed directly to your registered Mobile Money number or Bank Account.
4. Interest, Fees, and Charges

Costs must be visible before acceptance.

  • All costs, including interest rates and processing fees, will be clearly displayed in a Key Fact Statement before you accept the loan.
  • You agree to pay the Total Amount Payable as per the agreed repayment schedule.
5. Default and Recovery

Late repayment may trigger penalties, reporting, and recovery action.

  • Failure to repay on time may result in late payment penalties.
  • Continued default will lead to reporting your details to the CRB, which may affect your future credit.
  • In the event of persistent default, YOO & TOO Capital Ltd reserves the right to initiate recovery proceedings.
6. Electronic Signatures

Digital acceptance is treated as legally binding.

You agree that clicking "Accept," "Apply," or "Submit" within the app or website constitutes a legally binding electronic signature under the Electronic Transactions Act (2011).

7. Governing Law

These terms are governed by Ugandan law.

These terms are governed by the laws of the Republic of Uganda.

Developer Implementation Checklist

Implementation requirements tied to the loan acceptance flow

  • The "Accept" button should remain disabled until the user has scrolled to the bottom of the Terms.
  • A Key Fact Statement should appear immediately before the final "Accept Loan" button, showing the Total Interest and Total Repayment in UGX.
  • Permissions such as SMS or Location should be requested via standard Android or iOS prompts only when needed and explained as being used for credit assessment.
  • The app should ideally allow users to download a PDF copy of these Terms for their records.
